Scope and Content

Letter from James W. Stewart, attorney to Ida Cahoon, indicating that a hearing on a real estate matter will not be necessary as the other parties had no case according to their attorney. 2000.FIC.02.129A: Carbon copy James W. Stewart Attorney At Law Williamson Building, Telephones { Bell Main 731 / Cuyahoga Cent 5816 Cleveland, O. December 20, 1910 Miss Ida M. Cahoon, North Dover, Ohio. Dear Miss Cahoon: I myself have been absent for five weeks in the Southwest, but returned the middle of last week. During my absence, Mr. White argued the demurrer to the answers filed by Mr. Horr for his clients, and the court sustained the demurrer, which disposed of the case so far as all of the persons for whom Mr. Horr filed an answer. There was one answer filed by Amos Smith, by some attorney in Lorain. He is locally represented by the farm of Tanner & Barber. I have called on Mr. Tanner since my return, and asked him either to withdraw his answer, which is what lawyers call a general denial, and therefore, not demurrable, or to file an answer the same as Mr. Horr, so that we can demur to it. He said to me, in fact while I was present, wrote a letter to his correspondent at Lorain asking permission to withdraw his answer, which will probably be done, and I am expecting to hear from him every day. If this is done, this will finally dispose of the cases in your favor. Yours very truly, Jas. W.
