Document of termination of lease between Henry A. Latourell and wife Elizabeth, with Kenneth Bateman and wife Rita. Document reads; Agreement to Terminate Lease. This agreement, made in dupliacte this __ day of November, 1957 by and between H. A. Latourell and Elizabeth, Husband and Wife, (herein called the "First Party") and kenneth LeLand Bateman and Rita Bateman, Husband and Wife, (herein called the "Second Party.") Witnessethn: Whereas, the parties hereto entered into a certain agrement of indenture of lease, dated march 16, 1954 wherein and whereby the First Party as leaser, leased unto the Second Party as lessee for the term of approximatly five yeaers the premises known as The Latourell Building, Designed as No. 336 N. Main Avenue, in the city of Gresham, State of Oregon; And whereas, the parties hereto desire to cancel and terminate said lease and to end the term thereby demised as of the 15th day of feburaray, 1958, and to release each other fromn their repsective obligations to keep, observe and proform the several covenants, conditions and agreements in said lease set fourth on their respective parts to be kept, observed and preformed: Now therefore, the parties hereto maturally convenant and agree, as follows: 1) That the said lease be, and the same hereby is, cancelled and terminated, and the term thereby demised hereby is brought to an end as of the 15th day of feburaray, 1958, with the same force and effect as if the term of said lease was, in and by the provision thereof, fixed to expire on feburary 15, 1958, and not on July 15, 1959, subject to the conditions hereinafter contained. 2) That the First Party and the Second Party be, and they hereby are, respectively released and discharged their respective obligations to keep, observe and preform the several covenents, conditions and agreements in said lease set fourth on their respective parts to be kept, observed and performed. 3) That this agreement shall be binding upon, and inure to teh benefit of, the parties hereto, and their respective successors and assigns. In witness whereof, the parties hereto have caused this agreement to be duly executed by affixing their hands and seals the day and year first above written.
