Dear Sir -
I received your letter last evening, / and have made my arrangements to go, + / take Mr. Cartwright with me, on the Holman / property tomorrow, to ascertain and discribe / that property by actual _ proper Boundaries in / the Ejectment Declaration. The obvious ori- / -ginal boundaries, by which the Hollman / property was discribed in the [river?] thereof, / in your father, the Lieu’t Governor’s, will of / that Property to your brother Philip, have as / I Expect, been Obliterated at the river, by the / freshest – When it carried off the mill. _ It is / necessary now, you know, under the Revised / Statute to discribe the property in Ejectment / with sufficient certainty by monuments or visi - / -ble boundaries __ which should [this?] found above / the Mill be obliterated yet - I can ascertain / such natural boundaries as to Enable me / to make a sufficient discription _ I shall / personally on the Spot pofsefs myself of all the inform - / -ation to Enable me to [??] for the rights of your / self + sisters property and shall Expect to serve / the Declaration in thid Case on Saturday
I think It will be right + proper / for us to docket the Judgment actually in the / Case of Kipp so as to fully perfect the Judgment / the Court has given us __ Ejectment much / like other Judgments in other actions settles / right definitively _ and as the same principle / is here decided as will govern in all the / other cases where your brother’s right or inter / est _ [truth?] of Croton is concerned we had better / have the Record filed__ the record is made /
[END OF PAGE 1]
Ready for me to [blow?] on Friday I purpose to / to have the [Corts T??ed] + the record filed / and will be ready immediately to demand from / Kipp whether he will forthwith pay the same / + surrender possession of your share _ and pay / the Mesne Profits __ I will observe also that / by the [reverse/second?] statutes, ??? now, instead of / a suit of trespafs for the mesne profits as formerly / we make a suggestion in the Judgment Record / in Ejectment for the rents + profits _ That is / the way [i?] make up this Judgment [R-?lle] _
You have not mentioned what shall be / demand, if they settle, for the mesne profits: / we can charge only for 6 years back now / under the present statute; but be it [more?] in / use he must pay it _ I should be glad if not / two much trouble you w’d say to me before / you came home what the [means?/ mesne?] profits / shall be __ I am driving these matters on / as fast as the law + careful [proceding] will / permit + you may rely on it will continue / to do so till you + your sister are in / the full realization of your rights in this property / and shall close the [partitions] suits now / pending this fall + and I trust the whole —
Next day after to morrow I shall be / able to advise you of the amount of the / decision of Col’[?] Hunt in your case against / Joshua Purdy ___ The Col[?] will make his [award?] / which I have drawn tomorrow _ and the day following you will hear
