White page, 42 by 33 cm, Folded in half, printed in black ink and written on in the same. Page is legal size, with the margins outlined in red. At the top of the page the words [ This Indenture] is printed in flowwing illustrated black type. This mortgage is between James Rosamond Jr in party with his wife Elizabeth Ann Janet Rosamond, And Bennet Rosamond. The Following is typed at the top of the page in small print: [ Mortgage with Dower - Short Form. AS Woodburn Law and General Printer, Ottawa. ] On the reverse side is the short form of the mortgage [Mortgage / From / James Rosamon Jr / to / Bennet Rosamond/ Securing $ 300.00 and / Interest at Eight per Cent. / Dated 19th June A. WOODBURN, Law and General Printer, Ottawa. ~ Main Text This indenture Made the nineteenth day of june one thousand eight hundred and seventy four (in pursuance of the Act respecting Short Forms of Mortgages,) Between James Rosamond the Younger of the Village of Almonte, Gentleman___________________ Hereinafter called “the Mortgagor, “ of the First Part, Eliza Ann James Rosamond ________________ the Wife of the said party of the First Part, made a party hereto for the purpose of barring her Dower merely , of the Second Part; and Bennet Rosamond of the same place Equire___________________ hereinafter called “”The Mortgagee”, of the Third Part; Witnesseth, that in consideration of Three Hundred Dollars of lawful money of Canada now paid by the said Mortgagee to the said Mortgagor, the receipt whereof is hereby acknowledged, the said Mortgagor doth Grant and Mortgage unto the said Mortgagee his heirs and assigns, FOR-EVER _________ All and Singular those certain parcel[S, has been crossed out] or tract[S, has been crossed out] of Land and Premises situate, lying and being in the Village of Almonte in the County of Lanark in the Province of Ontario and Dominion of Canada, Being Composed of Lots numbers twenty three on Union Street and Forty One on Mitcheson Street in the Rosamond Section in the said Village as laid down on a plan thereof made by Andrew Bel P.S.S. filed in the registry Office for the North Riding of the County of Lanark ~ bottom quarter of this document is unused and crossed out except for one word in the bottom right corner~ Provided ~ top portion of the blank portion of this document’s page has been crossed off. ~ Provided, This Mortgage to be void on payment of Three Hundred Dollars _______________ Of lawful money of Canada, with interest at eight ______per cent, per annum as follows: the said sum of three hundred dollars in three equal annual installments with interest at said rate first instalment of principal and interest to be due and payable on the nineteenth day of june AD 1875_________________________________________________________________ Together with interest at the rate aforesaid upon all arrears of Interest remaining unpaid after the maturing thereof __ and Taxes and performances of Statute Labor._______ The said Mortgagor covenant(s, has been scratched out) with the said Mortgagee THAT the said Mortgagor will pay the Mortgage money and interest , and observe the above Provisio: That the said Mortgagor hath a good title in fee simple to the said Lands: And that he hath the right to convey the said Lands to the said Mortgagee; and that on default; the said Mortgagee shall have quiet possession of the said Lands FREE from all encumbrances; And that the said Mortgagor will execute such further assurances of the said Lands as may be Requisite; And that the said Mortgagor hath done no act to incumber the said Lands: [the following has been crossed off with a single line running through the sentences] And that the said Mortgagor will Insure the Buildings on the said Lands to the amount of not less than______________________________ currency; [Crossed out portion ends] And that the said Mortgagor doth release to the said Mortgagee all his claim upon the said Lands, subject to the said proviso._______________________________________Provided, that the Mortgagee on default of payment for one_____month may, on giving ten days public ______notice ____________________________________________________________________________ enter upon and lease or sell the said Lands.______________Provided, that the mortgagee may distrain for arrears of Interest; Provided, that in default o. The payment of the Interest hereby secured, the Principal hereby secured shall become payable ; Provided, that until default of payment the Mortgagor shall have quiet possession of the said lands.________ And the said Eliza Ann Janet Rosamond_ Wife of the said Mortgagor, hereby bars her dower in the said lands. __________________________________________________________________________ In witness whereof the said parties hereto have hereunto set their Hands and Seals the day and year first above written.
