Hoyles Messrs Greig & Greig, Barristers, &c., Almonte, Ont. Dear Sirs: Anchor Knitting Co. VS Thoburn. I have prepared Statement of Claim herein, and am enclosing it to you and am returning all the papers left me by your Mr. P. A. Greig by concurrent express. You will, of course, fill in the description of the land in paragraph 2. I have endeavored in the way i have drawn paragraph 4 to cover the log, which is probably bolted to the rocks, which mr Greig mentioned, and this in a way that will possibly not draw the defendants’ attention specifically to it. I have claimed a declaration of rights, a perpetual Injunction and damages, and it would appear that we are entitled to Injunction and normal damages, simply on the ground that if we do not bring action , the defendants might obtain some rights by prescription, Rennington vs. Brinsop, Hall Co., 5 Chancery. AYLERSWORTH, WRIGHT, MOSS & THOMPSON. Messers. G. & G. -2- Division, 769. It is also clear that there is a right to such actual damages, as can be proved. While I think the defendants may very likely ask for and obtain some particulars of paragraph 4, I have left it in the shape in which it is with the hope of not calling their attention to the fact that we are attacking the log above mentioned.
