Transcription : ANCHOR vs THOBURN Statement of H.W.Lundy - Man. Director of Piff Co, Defendants in August 1907 constructed a dam stretching across the Mississippi River in the Town of Almonte from at or near the upper end of Wylie Milling co. 's permanent dam to the pier close to the Northern end of the snail island on the Southern side of the River* A- log lies along the bed of the River from pier to shore of island. Shortly after said dam was erected Writ in this action was issued. This spring the said xxxxxx temporary dam was carried away by the water and ice and has Dot vet been replaced. For some years' back the defendants have erected dams in the same place or nearly so as the one above mentioned and I think that each spring the one erected in the preceding year has been carried away by the water or ice. I do not know when a dam was first created across the river in this place. I do not know whether or not there was any year since dam first erected within which a dam was not constructed here. I have heard that one year was allowed to pass without a das being erected here. I understand this happened within the last 10 years. I have heard that the former owners of the power where the electric light plant now is located destroyed or seriously damaged the dam every tine it was put up. About five years ago the Wylie Milling co overhauled and repaired their permanent dam and then or about that time laid a log along the bottom of the river - up the stream and pointing outwards from their permanent dam. The lower end of log was joined to upper end of permanent dam. This log is higher than top of permanent dam. This log still there. - Anchor vs Thoburn - - statement of H. W. Lundy - Dan constructed by Defendants holds back the water till the water reaches top of dam unless mills above us are running. If water has not reached top of dam and all mills above us are not running, we have either to close down or use steam. It depends on height of water above dam whether or not we are injuriously affected If water . not high enough to run over ledge in centre of river, if dam were not there, we are not affected by dam. If water high enough to run over ledge [] dam was not there, we are injuriously affected even if all mills above running provided water is not very high. We are particularly injured at night as we have to not only use steam but have to put on an extra man to run engine. When Electric Light Plant running and Wylies Milling Co 's Mill running, a current is created which carries water coming from Wylie Milling co'wheel down opposite side of river from us. By erection of this dam, flow of water is irregular or more irregular than otherwise would be. Water comes down in unequal quantities. - Statement of H. W. Lundy - continued About six years ago when dam was on. Electric Light Committee arranged with me for to allow the dam to remain up as they were putting dynamo in Wyile's Mill to supply Town with Electric Light. I consented to its remaining up that year* I had been protesting to the Wylies against the erection of said dam. The coommittee paid me for allowing the dam to remain up that year. [end]
