Eighteen Hundred and Eighty in pirsuance of the Act respecting [first] forms of conveyances. Between Robert Bell of the village of Carleton Place in the county of Lanark Esquire [J_me_tc] under the wife of the Honorable James Wylie late of the township of Ramsay in the county of Lanark Deceased of the First part. James Hamilton Wylie of the Village of Almonte in the county of Lanark Merchant of the Second part. Janet Campbell of the city of Aberdeen in Scotland Widow of the third part. James Gibb of the city of Quebec in the province of Quebec merchant of the fourth part. Margaret Gilles Malloch of the city of Hamilton Widow of the fifth part. James Wylie of the city of Hamilton in the County of Wentworth Gentleman of the sixth part. William Hamilton Wylie of the village of Carleton Place aforesaid Woollen Manufacturer of the seventh part. Donald MacLellan of the city of Hamilton Bookseller and Alexander MacLaggan of the same place Gentleman [Jr__ree] under the will of Donald Micholson late of the city of Hamilton deceased of the eighth part. Mary Hamilton Gibb wife of the said James Gibb Merchant. Margaret [Maulana] Wylie wife of the said William Hamilton Wylie and Maria C *--- Wylie wife of the said James Wylie all of the thirteenth part. Whereas under the will of the said the late honorable James Wylie deceased each of the parties hereto of the second third fifth and tenth parts became entitled to an undivided one fifth part of an undivided two thirds interest in the lands and premises described in Schedule A hereto attached forming part of the partnership Estate of the late firm of “James Wylie Hon.” of which the said The Honorable James Wylie and the late William Gilles Wylie were partners the said The Honorable James Wylie as such partner being entitled to a two thirds interest in the said lands and the said william Gillies Wylie as such partner being entitled to a one third interest herein- And Whereas upon the death of the said William Gillies Wylie which took place in the year of our Lord one thousand eight hundred and fifty one the parties hereto of the sixth and seventh parts each became entitled as sole heirs of the said William Gilles Wylie to an undivided half of an undivided third portion of the said lands described in the said schedule A also under the will of the said The Honorable James Wylie deceased equally to the remaining one fifth of the said two thirds interest in the said Lands in Schedule A being the ~ end of page 2 ~ Portion given by the said will to William Gilles Wylie their father- And Whereas under the said will the said The Honorable James Wylie deceased the parties hereto of the second third fifth and ninth part became each entitled to an undivided one fifth share of the lands and premises described in schedule B hereto attached said lands being the individual property of The Honorable James Wylie deceased, And Whereas under the said will the said parties hereto of the sixth and seventh parts each become entitled to an equal undivided share of the remaining one fifth of the said lands in schedule B being the portion of their father William Giles Wylie in the said lands in schedule B. And whereas the said Mary Watson Conveyed all her interest in the said lands in schedule A and B to the party hereto of the fourth part in security for certain moneys advanced to her which still remain unpaid and the said parties of the tenth and twelfth parts join in this conveyance for the purpose of relinquishing all interest in the lands hereby conveyed, by the said James Gibb and enabling this partition to be made. And Whereas the party hereto of the sixth part mortgages all his share and interest in all the said lands in schedule A and B to the said Donald Micholson deceased to secure the sum of five thousand dollars And interest and the said mortgage has now become vested in the parties hereto of the eighth part as [fmetees] under the will of the late Donald Micholson deceased and the said mortgage is now long past due. And whereas the party of the sixth part by way of further change mortgaged ~ end of page 3 ~ His equity of redemption in all the lands in schedules A and B for the parties hereto of the ninth part to secure the sum of ten thousand dollars or thereabouts and interest which said mortgage is now long past due and the said share on interest of the party of the sixth part when sold will not realize sufficient to cover the said mortgage and the party of the sixth part since became insolvent and his interests in all the said lands (subject to the said mortgage) because vested in the party of hereto of the eleventh part and the said parties of the sixth and eleventh part join in this conveyance for the purpose of relinquishing all interest in said lands and enabling this partition to be made- And whereas the parties hereto having the beneficial interest in the said lands have by agreement among themselves divided the same into portions and allotted for each the parcel hereafter conveyed to her him or them respectively. And whereas the legal estate in some of the said lands is vested in the party hereto of the first part as [guslee] under the will of the said the Honorable James Wylie deceased and in [oifier] of the said lands is vested in the party hereto of the second part under a decree made in a certain cause in the Court of Chancery for Ontario of Wylie versus Wylie and in [often] of the said lands is vested in the said trustees under the will of the late Donald Micholson by virtue of the mortgage hereinbefore in part received and in [often] of the said lands in the said party of the seventh part and the parties hereto have requested the said parties having the legal estate to convey the same in manner hereinafter set out And whereas this investment is executed for the purpose of carrying out the said agreement for partition hereinbefore ~~ End of Page 4~~ In part recited made between the parties hereto and is intended to vest in each of the parties hereto in fee the lands and premises of the said in part recited agreement allotted to her him or them respectively Now this indenture Witnesseth that in pursuance of the said in part [reciled] agreement and consideration of the sum of one dollar the receipt whereof each of the parties hereto hereby acknowledges all the parties hereto except the party of the second part hereby grant bargain sell assign transfer and set over unto the party hereto of the second part all and singular all their estate right title and interest of in and to the lands described as parcel number one in schedule C hereto attached. And for the consideration aforesaid all the parties hereto except the party hereto of the said part doth hereby grant bargain sell assign transfer and set over unto the party hereto of the third part. All and singular all their estate right title and interest of in and to the lands and premises described as parcel number two in said schedule C hereto attached. And all the said parties hereto except the party of the fourth part do hereby grant bargain sell assign transfer and set over unto the party hereto of the fourth part all and singular all their estate right title and interest of in and to the lands and premises decided as parcel number three in said schedule C hereto attached. The lands in the town of pembroke being conveyed subject to all arrears of taxes that may have accrued thereon or any sale for such arrears of Taxes. And all the said parties hereto except the party of the fifth part do hereby grant bargain sell assign transfer and set over unto the party hereto of the fifth part all and singular all their estate right title and interest. ~ end of page 5~ Of in and to the lands and premises described as parcel number four in said schedule C hereto attached. And all the said parties hereto except the said party of the seventh part do hereby grant bargain sell assign transfer and set over unto the party hereto of the seventh part all and singular all their estate right title and interest of in and to the lands and premises described as parcel number five in said schedule C hereto attached. And all parties hereto except the parties of the eighth part do hereby grant bargain sell assign transfer and set over unto the parties hereto of the eighth part. All and singular all their estate right title and interest of in and to the lands and premises described as parcel number six in said schedule ‘C’ hereto attached. To have and to hold unto and to the use of each of the said parties hereto of The second Third fourth fifth and seventh parts and each of their heirs and assigns forever absolutely each of the said parcel of land so hereinbefore conveyed to each of them respectively. Subject nevertheless to the reservations limitations provisoes and conditions expressed in The original grant thereof from The Crown. And to have and hold unto and to the use of the parties hereto of the eighth part their heirs and assigns forever the parcel of land hereinbefore conveyed to them ( subject nevertheless to the reservations limitations provisoes and conditions expressed in the original grant thereof from the Crown upon the following trusts. ) That the parties of the eighth part shall sell and dispose of the same in such manner as they may deem advisable and for the best price that can reasonably be obtained for the same and after paying all the ~ end of page 6~ Charges and expenses of and attending The partition of the lands hereinbefore described and the charges and expenses of carrying out the said trust then to apply the proceeds in payment of the said mortgage in favor of said Donald Micholson vested in the parties of the eighth part and The residue to pay unto the said parties of the ninth part on account of or in satisfaction of their mortgage and if there is any residue then to pay such residue to the parties of the eighth part in the meantime make leases of the said lands as they may deem advisable. The said parties of the first and second parts hereby covenant with each of the parties of the third fourth fifth seventh and eighth parts that they will execute such further assurances of the said lands as may be necessary. And each of the parties hereto of the second third fourth fifth seventh eighth and ninth parts hereby covenant with each other that they have done no act to incumber their interest in said lands as hereinbefore set out or any part thereof Ant that they will execute to each other such further assurances of their said interest in said lands as may be necessary And each of the parties hereto of the Thirteenth part hereby bars her dower in all the said lands. It is hereby declared and agreed between the parties hereto that none of the streets or parts of streets laid down on the plan of Burnside mentioned in the Schedules hereto attached shall require to be opened up notwithstanding the filing of the said plan and the sale of lots thereon heretofore made and notwithstanding these presents except(ing has been crossed out) the following namely. All that part of Hamilton Street which ~ end of page 7 ~ Passes through The said lands that part of Maitland Street lying North of the line formed by the Extension across Maitland Street of the boundary between lots numbers Three and eight in Burnside. All of John Street; that part of Malloch Street lying between Maitland Street and The River that part of James Street lying between Maitland Street and the River, That part of William Street lying between Hamilton Street and the South Side of Mary Street and all that part of Malcolm Street lying between Hamilton Street and the north west boundary of that part of Burnside Described in Parcel Number Six of Schedule C Hereto Attached. And it is Further Agreed that the grants herein made to the parties of the second third and seventh parts respectively of the East halves of Lots eighteen, nineteen and twenty respectively are made reserving a right of way fifty feet wide from the southern boundary of the said East haef of said Lot eighteen across The said East halves of Lots Eighteen Nineteen and twenty to the allowance for road between said lot number twenty and lot number Twenty One in the same concession and the course and description of the said right of way is as follows - Commencing on the northern limit of Maitland Street on said Plan of Burnside and continuing the said Street northerly in a Straight line one hundred and eighty yards over the said Lot Eighteen then turning Westerly in a Course at right angles to the boundary between The east and West halves of said lot Eighteen and continuing westerly to the said boundary then northerly along the easterly side of the boundary between the east and west halves of eighteen nineteen and twenty in the same concession to the north east side of the allowance for road between said lots twenty and twenty one ~ end of page 8 ~ In the same concession the said Road or right of way to be enjoyed in common by the owners of the Easthalves of said Lots eighteen nineteen and twenty and of Lots in Burnside their heirs and assigns forever and to be traversed by all other persons lawfully going to and returning from the said lands or any of them. Thence running parallel to Park Street through the center of the said stone partition wall one hundred and fifty feet more or less to the rear of the said lot number sixty four. Thence north fifty six degrees east forty one feet seven inches more or less to the north easterly boundary of the said lot- Thence north thirty four degrees west along the said easterly boundary one hundred and fifty feet more or less to the place of beginning, the said stone partiton wall forming a party wall common to the owners of the two respective parts of said lot number sixty four on which the said warehouse and the dwelling house stand, their heirs and assigns. II Also all and singular that certain parcel or tract of land and premises situate lying and being in the Town of Pembroke in the county of Renfrew and Province of Ontario Containing by admeasurement five fifths of an acre being composed of Town lots numbers two and four in Block Letter T in the Moffatt Section of the Said town of Pembroke. III Also all and singular those certain other parcels or tracts of land and premises ~~ End of page 13 ~~ Situate lying and being in the Township of Ramsay in the said county of Lanark being part of the front or west half of Lot number twenty three in the second Concession of Ramsay aforesaid and being all the lands conveyed (by ~ has been scratched out) to the late Honorable James Wylie in his lifetime by the late David Campbell in his lifetime by deed dated [19th ~ has been scratched out] nineteenth day of February 1852 and Registered in the Registry Office for the County of Lanark on the [24th ~ has been scratched out] twenty fourth of February 1852 in Liber A for Ramsay as number 287 and being all the lots and streets laid down on a plan of the said lands drawn for the estate of ‘James Wylie and Son’ by JMEO [MC ~ has been scratched out] Cromwell P.L.S. in June 1855 and filed in The Registry Office at Almonte and called the village of ‘Clifton’ and now called the village of ‘Clayton’ excepting nevertheless hereout and herefrom the following Lots on the said plan that have been sold namely lots numbered from four to twelve both inclusive, Lots numbered fifteen and seventeen, Lots numbered from twenty eight to thirty seven both inclusive and that part of Lot number eighty two sold and conveyed to one R. McKay by deed duly registered and all other lots that have been sold thereout reserving also to the owners of the several lots that have been so sold respectively such rights to use the parts of Streets on which the Lots that have been sold are situated on said plan as by law they are respectively entitled to. Parcel Number Four All and singular that certain parcel or tract of land and premises situate lying and being in the Township of Ramsay in the county of Lanark and Province of ~ End of Page 14~ Ontario being composed of all that part of the last half of Lot number seventeen in the Ninth concession of the Township of Ramsay aforesaid which lies on the east side of the Mississippi River containing by admeasurement sixty acres be the same more or less. Parcel Number Five I All and singular that certain parcel or tract of land and premises situated lying and being in the Township of Ramsay in the County of Lanark and Province of Ontario and being composed of parts of the property known as ‘Burnside’ described in parcel number one in this Schedule C and being bounded on the north east by a line drawn parallel to William Street on said plan of Burnside and thirty three feet north east of that street and extending from Hamilton Street (on said plan) to the north west limit of the said Township lot number Seventeen Excepting thereout and therefrom. Lots numbers seventy seven and seventy eight and part of lot number forty on said plan and the same having been heretofore sold. Also excepting thereout and therefrom that part of William Street lying between Hamilton Street and the southeast side of Mary street on said plan containing by admeasurement twenty nine acres and sixteen hundredths of an acer be the same more or less. Also the east half of Lot number Twenty in the ninth concession of the Township of Ramsay containing by admeasurement one hundred acres be the same more or less including the water power thereon and the right [of ~ has been crossed out] to back water on the rapids situated on the ~ end of page 15 ~ East halves of lots eighteen and nineteen in the same concession for the purpose of utilizing the said water power on Lot Twenty. Reserving always the right of way fifty feet wide across the said lot twenty described in the deed hereto annexed. III Also all and singular those certain lots or parcels of land situate in the Village of Almonte in the said county of Lanark being composed of lots numbers eighty seven and eighty eight on Almonte Street in the Cameron Section of the said Village of almonte as laid out on a plan of said section drawn by Andrew Bell P.L.S. dated the [27th ~ has been scratched out] twenty seventh of December 1869 and Registered in the Registry office for the North Riding of the County of Lanark.
