Deed from William Currie to John Baird. Richard Dulwage was the witness. The deed was for $1156.66. It is five pages long. Transcription of 2013.57.16 [page 1] This indenture made in duplicate the sixteenth day of June in the year of our Lord one thousand eight hundred and seventy- Between William Lurrie of the Town of St Mary’s in the County of Perth and Province of Ontario, Merchant of the first part ; and John Baird of the Township of Ramsay in the county of Lanark and Province aforesaid, Esquire of theSecond Part - Bthenead by an indenture of Mortgague mage in Pursuane of the act respecting short formes of mort-gages, bearing date the thirty first day of January in the year of our Lord one thousand eight hundred and sixty eight made between Nesleyey Tennant of the Village of Almonte in the County of Lanark and Provine aforesaid merchant (hereinafter called the Mortgagor) of the first park , Sarah anne Jennaut his wife , of the second part and the said WIlliam Currie the party heretoof the first part (hereinafter called the mortgagee) of the third part, for an in consideration of the sum of one thousand one [thousand, has been crossed out] hundred and fifty six dollars and sixty six cents the said Nesleyey Tennant did grant and mortgage unto the said william Currie his heirs and assigns forever, among of other lands, all and singular that estate parcell or tract of land and premices sitting lying and being in the villlage of Almonte in the County of Lanark and province of Ontario, being composed of Village lot number sixteen on Farm street in the said Village of Almont as laid out on a plan of the Baird Section of the said Village drawn by I.M. O’Connell , Provincial land surveyor and filed in the Regietcy office for the North Riding of the said county of Lanark ; subject, never the less to a provision in the said Mortgage contained , that the said Mortgage should be void on paynet of one thousand one hundred and fifty six dollars and [continued on page 2] Sixty - six cents of of lawful money of Canada as follows - The said sum of one thousand one hundred and fifty six dollars and sixty six cents on or before the first day of Febuary which would be in the year of our Lord one thusadn eight hundred and Sixty Nine , and taxee [word uncertain] performance of Statue before --- and whereas by the said Indenture of Mortgage the said Sarah Anne Tennant, the party thereto of the second part did bar her Dower in the said hereinbefore mentioned lands. And whereas it was further provided in and by the said in part recited Indenture of Mortgage that the said William Burrie on default of pay must for oen month on giving one months notice, might enter upon and lease or sell the said lands. And therefore the said Nesleyey Tennant did not not did any other person or persons for him pay to the said William Currie the said sum of one thusand one hundred and fifty dollars and sixty six cents on the day and at the time when the sum became due and payable as aforesaid, but therein made efault and the sum of six hundred and forty one cent of one thousand one hundred and fifty six dollars and sixty six cents, together with interest thereon still remains due and unpaid. And whereas default having been made is aforesaid , the said William Currie pursuant to the aboce recited proviso in the said Mortgage contained caused a notice demanding payment of the said sum of six hundred and forty one dollars and seventy five cents and the sixteen thereon to be peronsally ordered upon the said Nesleyey Tennant on the Twenty Eighth day of Febuary in the year of our Lord one thousand eight hundred and seventy -- [page 3] And whereas, the said Nesleyey Tennant , after the ececutive of the said in part recited indenture of Mortgage eecuted a further Mortgage on the said above descrived premises among of other lands , to one John Adam Teskey , and several Creditors of the said Nesleyey Tennant also recovered judgments against him and placed Noite [unknown word] of Fieri Facias against his lands and tenements in the hands of the sheriff of the said county of Lanark to be executed ; and the said John Adam teskey and the said several executive creditors have been duly and respectively served with a like notice demanding payment of the said Morgage money - And on thereas the said Nesleyey Tennant prior to the executiore of the said first iss part recited indenture of Mortgage had executed two several mortgages upon the said above described premises among the other lands one of said morgagee being to the said John Baird for the sum of four hundred and twenty seven dollars bearing intrest at the rate of ten per centum per annum upon which there is still due for principal money and intrest the sum of five hundred and eighty four dollers and eighty one cents - and the otherto the Bank of Montreal for the sum of two thousand dollars which said last mentioned mortgage has since been assigned to one Kenny Moorhouse , and there is still [crossed out] now due upon the cause for principal money and interest the sum of eight hundred and twenty three dollars. And whereas the said William Currie after the expiration o fone month from the service of the aforesaid notices, did cause the aforesaid mortgaged premisies to be advertized and published for three weeks in the Almonte Gazett news paper published in the Village of Almonte aforesaid to be sold by public auction at the Almonte House in the said Village of Almonte on Saturday the eleventh day of June in the year of our Lord one thousand eight hundred and seventy after the hour of twelve O’Clock , noon, and the said lot or parcel of [page 4] Land being the and there put up to sale i the usual mannerm the said John Baird , became the purchaser thereof being the last and highest bidder therefore, for the price or sum of one thousand eight hundred and fitfy dollers. And whereas It was a condition of the said sale that the said John Baird should retain out of the said sum one thousand eight hundred and fifty dollars so bed as aforesaid the said sum of five hundred and eighty four dollers and eighty one cents as due to him as aforesaid and also pay satisfy and discharge thereout the said Mortgage to the said Kerry Moorhouse ,upon which there is due the said sum of eight hundred and tewnty three dollars as aforesaid, And whereas the balence of the said purchase money after the aforesaid payments amounte to the sum of four hundred forty two dollars and [word illegible ] cents, Now this indenture witneseth that the said William Currie in consideration of the premises and the said sum of the four hundred and forty two dollers and nineteen cents of lawful moeny of Canada to have in hand paid by the said John Baird at or before the sealing and delivery of these present (the reciept whereof is hereby acknowledged ) and in pursuance of the powers vested in him and by the said first in part recited Indenture of Mortgage , hathe by way of conveyance only and not by conveyed and confirmed, and by these presents doth frant bargin sell alien , assing , convey and confirm unto the said John Baird his heirs and assigns forever, all and singular the said parcell or tract of land and premices here in before mentioned and descived, and situate , lying and being as hereinaftoresaid : To Have and to Hold the said parcel or tract of land and premices with all the privilages and appurtances thereunto belonging , unto the said John Baird, his heirs and assings [forever , has been scrached out] to and for [page 5] His and their sole and only use forever, freed and obsolutly discharged from all equity and sught of redemption by the said nesley Tenant , his heirs and assigns : Subject however to the payment conditions and agreemente contained in the said prior mortgage as aforesaid. And the said William Currie , for himself his heirs, executors and administrators , doth covenant promise and agree to and with the said John biard his heirs, and assings, that the said debt or sum of six hundred forty - one dollars and seventy fice cents and the said interest thereon, were at the time of said sale and yet are due and unpaid, and that the cervicese of the aforesaid notices demanding payment as aforesaid and the said sall were according to the requirments of the land first in part recited indenture of mortgage ; and that not withstanding any act [deed, has been scratched out] matter or thing by him the said William Currie or any other person or personse claiming for, under or in trest for him , made , done, omitted, commited, executed or knowing by or wilfully suffered to the contrary , the said William Currie now hath in himself good right and absolute authority to convey and see sue the estate and interest which he the said Neslay Tenant had in said described land and premices on the day of the date of the said first in part recied Indenture of Mortgage unto and to the use of the said John Biard his heirs and assigns , in manner aforesaid according to the true intent and meaning of these presents In witness thereof the said parties to these presents have hereunto set their Hands and Seals Signed Sealed and Delivered } William Currie In Presence of Richard Dulwage [On the back ] I certify that the within instrument is duly entered and registered in the Registry Office for the North Riding of the County of Lanark in book 3 for the Village of Almonte at 10O’Clock AM of the 24th day of June 1870 number 319 Menzies Registrar Deed William Curie To John Baird County of Lanark ToWit } I Richard Dulwage of the Village of Almonte in the county of Lanakr, student at law, make oath and say : 1st That i was personally present and did see the assinged instruent and duplicate duly signed, sealed and executed by William Currie on of the parties thereto. 2nd that the said instrument and duplicates wer executed at the village of ALmonte in the said County of Lanark 3rd that I know the said parties - 4th That I am a subscribing witness to the said instrument and duplicate - Sworn before me at Almonte in the county of Lanark this 23rd day of June A.D. 1870 J.
