Mortgage from B & W Rosamond & Co. to James Rosamond. $24000 is to be paid with interest of 7.5% per annum $4000 is to be paid on April 1, 1869. $10,000 on April 1, 1870. $10,000 April 1, 1871. Interest is to be paid quarterly on the first days of July, October, January, and April. Four page long, attached at the top left corner with a green ribbon and a red seal. Transcription of artifact 2013.57.18: This Indenture made the twenty third day of May one thousand eight hundred and sixty six, in pursuance of the Act respecting short forms of mortgages, Between Bennet Rosamond, of the Village of Almonte in the Township of Ramsay in the County of Lanark and Province of Canada, William Rosamond, of the same place, and George Stephen, of the city of Montreal in the said Province, Woolen Manufacturers, carrying on business as co-partners in the said Village of Almonte under the name, style and firm of “B & W Rosamond & Co.” (hereinafter called the Mortgagors) of the first part. James Rosamond, of the aforesaid village of Almonte, Esquire, (hereinafter called the Mortgagee,) of the second part: and Anne C Stephen, wife of the said George Stephen, one of the said Mortgagors, made a party hereto merely for the purpose of barring her dower, of the third part. Witnesseth that in consideration of the conveyance by the said mortgagee to the said mortgagors of the lands and premises hereinafter described and of the sum of five shillings of lawful money of Canada now paid by the said mortgagee to the said mortgagors (the receipt whereof is hereby acknowledged) the said mortgagors do grant and mortgage unto the said mortgagee, his heirs and assigns forever, all and singular those certain parcels or tracts of land and premises, being a mill site and other tracts of land, situate lying and being in the aforesaid Village of Almonte (formerly called “Ramsayville” and afterwards “Waterford”) in the Township of Ramsay and Count aforesaid, and may be more particularly described as follows, being composed of a part of the east half of lot number fifteen in the ninth concession in the Township of Ramsay aforesaid, containing by admeasurement two roods, be the same more or less, which said mill site or two roods of land is butted and bounded or may [the following is written inside the document] May be otherwise particularly described as follows, that is to say commencing on the east side of Mill Street in the Village of Almonte at a distance of forty three and three fourths links from the west angle of the late Daniel Shipmans stone building for a grist mill, said distance being set off on a line parallel to the end wall of said stone building and thence broadened [spelling uncertain] on a course South thirty two degrees thirty minutes west to intersect Mill street: thence along the East side of Mill Street north seventy degrees West two chains two links more or less, to within six links of the timber slide; then on a course parallel to said slide north sixty five degrees East four chains five links, more or less, to the water at the East side of the bottom of the dam: then south twenty nine degrees East twenty two and three fourths links for width of flume: then south sixty five degrees west one chain thirty links: then south forty nine degrees East nineteen and one fourth links: then south thirty two degrees thirty minutes west one chain eighty seven links, more or less to the place of beginning - Together with the right and privilege of drawing water from the dam of the late Daniel Shipman, deceased, for all necessary uses on the said land and premises, and of allowing such water to be discharged into the stream below without destruction- Also another part of the said east half of lot number fifteen in the ninth concession of the said Township of Ramsay, containing by admeasurement six thousand one hundred and ninety square feet, be the same more or less, and may be better known and described as follows, that is to say, as being the western part of village lot letter K, as laid down on a plan of the Estate of the late Daniel Shipman, made by J.M.O. Cromwell, and being butted and bounded as follows, that is to say, commencing at a point on the north or East [the following is written on the next page] (folio 3) Or East side of said Mill street in the village of almonte and which is distant westerly from an iron post planted in the rock on said side of Mill Street and in a line with the west side of the aforesaid stone grist mill now erected on said lot letter K and which post is distant from the said grist mill twenty two feet three inches and also distant from the south east corner of the stone building used as a woolen factory erected on the first described piece of land twenty nine feet nine inches: thence (all the bearings following being calculated from the true astronomical meridian) north twenty four degrees twenty six minutes east eighty eight feet nine inches: then south sixty five degrees thirty four minutes east seventeen feet four inches: then north forty degrees thirty five minutes east fifty nine feet six inches to the edge of the water in the Mississippi River: then in a northerly direction along the edge of the water in the said river forty nine feet, more or less, to the said premises above described: then south westerly along the south and east boundary of the said above described premises to the north side of Mill Street: then south seventy seven degrees forty two minutes east, twenty four feet nine inches, more or less to the place of beginning Also another part of the said east half of lot number fifteen in the ninth concession of the said Township, containing by admeasurement one third of an acre, be the same more or less, and may be better known and described as being the west half of lot letter E on Mill street in the said Village of Almonte and also a piece of ground between said half of lot letter E and Farm Street, which said parcels of land may be described as follows, commencing on the south side of mill street in the said Village and at the limit between said lot letter E and a parcel or plot of ground deeded [the following is written on the next page] Deeded by the late Daniel shipman to one James Burwood: then south seventy one degrees four minutes east along said side of mill street ninety four links, more or less, to the centre or said lot letter E: then south eighteen degrees twenty minutes west two hundred and six links: then north seventy one degrees four minutes west ninety four links, more or less, to said Burwood property: then north eighteen degrees twenty minutes east two hundred and six links, more or less, to the place of beginning - Again commencing at the south western angle of said lot letter E: then south seventy one degrees four minutes east ninety four links, more or less, to the centre of said lot letter E: then south twenty two degrees thirty minutes west one hundred and thirty five links, more or less, to Farm street: then north sixty seven degrees thirty minutes west along Farm street one hundred and thirteen links, more or less, to Agnes Paterson’s land: then north easterly following the boundary of said Agnes Paterson’s land and the boundary of Elizabeth Paterson’s land one hundred and thirty four links more or less to the place of beginning. Also those other tracts or parcels of land and premises being composed of part of the east half of lot number sixteen in the said ninth concession of the Township of Ramsay aforesaid, containing by admeasurement four acres and one hundredth part of an acre, be the same more or less, commencing at the water’s edge on the south side of the north branch of the Mississippi River and at the centre of one of three cedar trees standing together a few feet above the upper falls and easterly of a small island in the channel of said branch of the river: then south three degrees thirty minutes west four chains and fifty links: then south fourteen degrees east one chain seven links: then south seventy eight [the following is written on the next page] (Folio 5) Eight degrees fifteen minutes west seven chains fifty links, more or less, to the waters edge in the Mississippi River: then following the windings and turnings of the waters edge on a northerly course with the stream to the foot of the falls: then following the twistings and turnings of the edge of the river against the stream to the place of beginning: second the small island which is mentioned in the description of the last herein described piece of land containing seven thousand square links, be the same more or less- and third the small point which is found into an island in time of high water, which lies adjacent to the west corner of the said last herein described piece of land, at the junction of the two branches of the river, and containing eighteen thousand square links, be the same more or less- Proviso- this mortgage to be void on payment by the said Mortgagors to the said mortgagee of the sum of twenty four thousand dollars of lawful money of canada with interest at the rate of seven and one half percent per annum, to be paid in the manner following, that is to say, four thousand dollars on the first day of april which will be in the year of our Lord one thousand eight hundred and sixty nine, Ten thousand dollars on the first day of april which will be in the year of our Lord one thousand eight hundred and seventy one- the interest at the rate of seven and one half percent per annum to be paid, on all unpaid sums of money, quarterly, namely on the first days of July, October, January and April in each and every year- the first of said payments of interest to be made on the first day of July [the following is written on the next page] July next- The said Mortgagors covenant with the said Mortgagee that the said mortgagors will pay the mortgage money and observe the above proviso that the Mortgagors have a good title in fee simple to the said lands - And that they have the right to convey the said lands to the said mortgagee and that on default the said Mortgagee shall have quiet possession of the said lands free from all incumbrances - And that the said Mortgagors will execute such further assurances of the said lands as may be requisite - and that the said Mortgagors have done no act to incumber the said lands- And the said Mortgagors do release into the said Mortgagee all their claims upon the said lands, subject to the said proviso- Provided, that the said mortgagee on default of payment for one month, may on one months notice enter on and lease or sell the said lands- Provided, that until default of payment the mortgagors shall have quiet possession of the said lands - And it is hereby further covenanted, declared and agreed by and between the parties to these presents, that if the said mortgagors, their heirs, Executors or administrators, shall made default of payment of any of the moneys hereby secured or mentioned, or intended so to be, or any part thereof, at any of the days or times hereinbefore listed for the payment thereof, it shall and may be lawful for the said mortgagee, his heirs, Executors administrators or assigns to distrain therefor upon the said lands, tenements, hereditaments and premises, or any part thereof, and by distress warrant, to recover by way of rent reserved, as in the case [the following is written on the next page] In the case of a demise of the said lands, tenements, hereditaments and premises, so much of such moneys as shall from time to time be, or remain in arrear, and unpaid, together with all costs, charges and expenses attending such levy or distress, as in like cases of distress for rent- And the said Anne C Stephen, wife of the said George Stephen, one of the said Mortgagors hereby bars her dower in the said lands- In Witness whereof the said parties hereto have hereunto set their hands and seals- Signed, sealed and delivered in duplicate in presence of Chas.
