Deed from R. W. Lee Ltd and Yorkshire Wool Stock of the Town of Almonte, dated 1919. Transcription : "Copy" This Indenture made in duplicate this 14th day of March A.D. 1919. In Pursuance of the Short Forms of the Conveyance Act. Between R.W. Lee Limited whose Office is at the Town of Almonte, in the County of Lanark, hereinafter called the Grantor of the first part, and Harry Hirsch and Ernest H. Josephy of Leeds England, trading as Yorkshire Wool Stock Mills, hereinafter called the Grantees of the second part. Witnesseth that in consideration of $26500. of lawful money of Canada now paid by the said Grantees to the said Grantors (the receipt whereof is hereby by them adknowledged (sic)) they the said Grantors do grant unto the said Grantees in dee simple All and Singular those certain parcels of land and premises, situate, lying and being in the Town of Almonte in the County of Lanark and Province of Ontario. Being composed of (first) a part of Lot number 22 on Mill Street in the said Town of Almonte as laid down on a plan of the said Town of Almonte made by E.T. Wilkie, P.L.S. and filed in the Registry Office for the North Riding of the County of Lanark, which part contains by admeasurement 5315 sq. feet more or less and may be more particularly described as follows that is to say: Commencing where the northerly side of Mill Street in the said Town of Almonte intersects the southern boundary of the slide property, then in an easterly direction following the said southerly boundary of the slide property 216 feet more or less to where a post has been planted ten feet east of a certain tail race, Thence southerly at right angles to said slide voundary line two feet more or less to within two feet of the Woollen Mill Flume referred to in a deed dated the 9th day of March, A.D., 1909, made by Sarah Ann Lee and others to the said Grantors, Thence south-westerly parallel to and two feet north of said woollen mill flume 51 feet more or less to the northern wall of the old woollen mill building thence north westerly along said wall 14 feet to the northern angle of said old woollen mill building, thence south-westerly along the all of the said woollen mill building and the prolongation of the line -2- of said wall 114 feet more or less to the aforesaid side of Mill Street. Thence westerly following the side of Mill Street 93 feet more or less to the place of beginning. Together with the Mill and Factory thereon and the water-wheel, shafting, gearing, and fixtures thereto belonging all of which said lands and premises are on a plan made by Andrew Bell, O.L.S. dated the 15th day of July A.D. 1902, and annexed to a certain deed dated the 29th day of July A.D. 1902, No, 2391 made between J.B. Wylie and Daniel Shaw of the first part. Harold Jamieson of the second part, Callie M. Wylie and Margaret Shaw of the third part and Richard W. Lee and Hirst Taylor of the fourth part, together with all the estates, rights, priveleges(sic) and easements of the Grantors in the tail race and waters thereof and the use of the waters leading from the lands and premises of Penmans Limited on and across the lands owned by the said J.B. Wylie and Daniel Shaw on the 29th day July A.D. 1902, and the lands hereby conveyed together also with the rights and privileges whenever the Penmans Limited are not using their water-wheel or driving their machinery by water and the water is running over the dam below the iron bridge connecting the north side of the river with Coleman's Island in the said Town of Almonte of drawing water for driving their wheels to be lead and conveyed from an opening two feet square in the bulk-head of the flume next the dam or pond the top of such opening to be four inches above the top of the dam across the south branch of the Mississippi River at the head of the falls by a sluice way or in any other way that the said J.B. Wylie and Daniel Shaw and the Grantees, their heirs and assigns may agree upon. Such sluice way or other construction to be bult on the outside of the north side of the flume formerly leading to the factory, formerly owned by the said J.B. Wyle and Daniel Shaw, from the said opening to the waters of the tail race from the factory of Penmans Limited where such waters are to be discharged, Provided that the sluice way will be so constructed and the flow of the water from and through such opening so regulated that no damage will be caused thereby to the lands and premises of the -3- owners of the lands and premises over which the tail race from the premises of Penmans Limited passes together also with the rights and priveleges(sic) of the Grantees their heirs and assigns with workmen and servants of entering upon the said lands, formerly owned by the said J.B. Wylie and Daniel Shaw and Harold Jamieson, their heirs and assigns at any time hereafter for the purpose of making such opening and building such sluiceway or other construction as aforesaid and together with the right of entering from time to time and at all time hereafter upon lands formerly owned by the said J.B. Wylie, Daniel Shaw and Harold Jamieson, their heirs and assigns for the purpose of opening or closing such opening or the amending, cleaning, rebuilding or repairing such sluiceway or other construction as aforesaid but it is distinctly understood that when Penmans Limited, their successors and assigns are using their waterwheel or driving their machinery by water or discharging such water into the tail race or when the water is not or ceases no matter from what cause running over the said dam below the iron bridge connecting the north side of the river with Coleman's Island the said opening is to be closed, together with the right to build a pier on that portion of land between the factory flume on said plan and the land hereby conveyed and extending easterly from the west side of the tail race from the premises of the Penmans Limited to the easterly limit of the lands hereby conveyed. Together also with the right to drill an opening not more than five inches in diameter through the wall of the old woollen mill building not more than three feet from the north corner of said building and such opening to be in line with the shafting on the 9th day of March A.D. 1909, running into the building on the premises hereby conveyed and also the right from time to time to place and keep in and through such opening for all time hereafter a line of shafting from the waterwheel of the said Grantees to the said line of shafting above mentioned. Subject however to the reservations mentioned and contained in the said deed dated the 29th day of July A.D. 1902, from J.B. Wylie and others to Richard W. Lee and Hirst Taylor. -4- (second), Those certain other parcels or tracts of land and premises situate lying and being in the Town of Almonte in the County of Lanark containing by admeasurement 22500 square feet be the same more or less. Being composed of that part of the lower slide property lately belonging(sic) to the Mississippi River Improvement Company east of stone bridge together with lot 23 on the north side of Mill Street as shown on a plan of the said Town made by E.T. Wilkie. O.L.S. and registered in the Registry Office for the North Riding of the County of Lanark and also the south half of the bed or channel of the south branch of the Mississippi River between the said stone bridhe and the dam opposite the upper end of the said lower slide, which said parcels or tracts of land are more particularly described as follows, that is to say: Beginning where an iron post has been planted in the rock on the southern side of (Mill Street at its intersection with the east) the lower slide property which is also the north side of Mill Street at its intersection with the east side of Stone Bridge Street. Thence north 8 degrees 45 minutes west (astra) 130 feet more or less to the centre of the channel of the south branch of the Mississippi River. Thence in an easterly direction following the centre of channel against the stream 257 feet more or less to the dam at the head of the falls opposite upper end of the lower slide. Thence in a south easterly direction along said dam 75 feet more or less to the pier at upper end of lower slide Thence in a north easterly and south easterly direction around the head or upper end of the lower slide 30 feet more or less to the eastern end of the southern side of the said lower slide property. Thence south 57 degrees 23 minutes west (astr) along the said southern side of slide 306 feet more or less to the place of beginning, the last mentioned course being marked out on the ground by iron posts planted in the rock. Also all the plant, machinery, stock-in-trade, fixtures, and assets and good will of the business heretofore carried on by the Grantors (excepting money in bank, money on hand, book debts, bills and accounts receivable, and Government Bonds which are to be and remain the property of the Grantors) subject to the Grantees -5- assuming the Grantor's obligations to complete contracts for the purchase of card clothing not to exceed $1000. To hand and to hold unto the said Grantees their heirs and assigns to and for their sole and only use forever. Subject nevertheless to the reservations, limitations, provisoes,(sic), and conditions expressed in the original grant from the Crown, Subject also to a certain agreement dated the 2nd day of February A.D. 1903, made between Richard Lee of the first part and Alexandra Wylie of the second part. The said Grantros(sic) covenants with the said Grantees that they have the right to convey the said land to the said Grantees notwithstanding any act of the said Grantors. And the said Grantees shall have quiet possession of the said lands, free from all incumberance(sic). And the said Grantors covenants with the said Grantees that they will execute such further assurance of the said lands as may be requisite. And the said Grantors covenants with the said Grantees that they have done no act to incumber the said lands. And the said Grantors releases all their claims upon said lands, In witness where of the said Grantors have hereunto fixed their Corporate Seal and the President and Secretary thereof have signed.
