Recites Yorkshire Wool Stock and Dunlop agreement indefinite -
Recital -- location of right of way not designated in
First mentioned deed (12' passageway) on Lot 22 -
recites James W. Wylie on 5th May 1914 by Deed No. 9943 conveyed to Dunlop parts of lots 21 and 22 and right to pass along a passageway (as above) with the right to build on the right of way at his own expense a foot walk 3" in width.
New agreement (No. IIO) recites James W. Wylie would at own expense build, r air, and keep in repair a bridge of the full width of the right of way where it crosses the tail race from Mill or water privilege further up the river (except the covering of the same) and that the expense of keeping the said right of way in repair except as aforesaid including the covering of the said bridge over the tail race should be borne by the said James W. Wylie end the said Party of the Second Part and their respective heirs and assigns.
"And whereas the exact location of the said right of way was not designated by the said first mentioned deed"
"And whereas the Parties hereto have agreed to enter into these presents for the purpose of designating the said right of way and of providing for the repair and upkeep of the same"
... agree with each other as follows: -
1. The site and course of said right of way over said Lot 22 on Mill Street is as follows:-
Commencing at the point where an iron post has been planted between said Lots 21 and 22 on Hill Street intersects the same, thence North 36 deg. 45 Min. East following the aforesaid side line and the prolongation thereof a distance of 87' 8* be the same more or less to that part of said Lot 22 granted and conveyed to said Party of the Second Part by said first-mentioned dated the 25th day of April, 1914, thence North 52 deg. 19' West following the SV liuitof the said lands so granted and conveyed to said Party of the 2nd part a distance of 12' thence South 36 deg. 45 min. Vest and parallel to first mentioned course to Northerly limit of Mill Street thence Easterly following Northerly lir.it of Mill Street to place of beginning.
2. the Party of the Second Part to have the right to build and maintain a foot-walk 3' vide at own expense.
3. Company at own expense to build, repair and keep repaired a bridge the Hull width of said right of way where it corosees the tail race from the Mill or water privilege further up the river (except the covering of the same)
4. The expense of keeping the said right of way in repair (Except as aforesaid) including the covering of the said bridge over said tail race shall be borne by the Company and the Party of the 2nd part and their respective heirs, executors administrators and assigns in equal XKKMMM moities.
Note - the "Company" referred to is the Yorkshire Co. the Party of the Second Part is Peterson Bros.
