A letter from Mike Schler, CPA, Chief Auditor to Mr. Wilbur P. McDonald, dated August 4, 1986. It is on State of Missouri, Department of Public Safety, DIVISION OF LIQUOR CONTROL letterhead, Jefferson City, MissouriContext
Dear Mr. McDonald:
It has come to my attention that some licensed domestic wineries are not posting their prices with this division as required by Section 311.334, RSMo.
Section 311.334, RSMo, provides in pertinent part:
"No intoxicating liquor and wine of any kind shall be sold by a wholesaler to a retailer duly
licensed to sell intoxicating liquor and wine at retail, or purchased by a wholesaler for a retailer
or by a retailer through a wholesaler, unless a schedule as provided by this section shall be filed
by the wholesaler with the Supervisor of Liquor Control and is then in effect."
In light of the foregoing section of liquor law it is the opinion of this division that licensed domestic wineries selling wine to licensed retailers must post their prices with this division. Licensed domestic wineries, however, are not required to post their prices if they only sell wine in its original package directly to consumers at the winery.
If you have further questions concerning price posting, please feel free to contact me.
Please give this matter your immediate attention.
Sincerely,Lexicon
