Q2022.21.62Scope and Content
A letter from Mr. Ralph R. Lashbrook, Supervisor in Charge, Alcohol and Tobacco Tax, on letterhead from U. S. Treasury Department, Internal Revenue Service, to Dr. Wilbur P. McDonald, dated March, 25, 1963. Included is Form 1541, Registration for Production of Wine for Family Use, that had been filled out by Dr. McDonald and received the day of the letter.Context
Dear Dr. McDonald:
Returned herewith is your copy of Form 1541, "Declaration of Intent to Produce Wine for Family Use." Your attention is directed to the last sentence of Section 240.540 of the Federal Wine Regulations which provides: "THIS EXCEMPTION DOES NOT AUTHORIZE THE PRODUCTION OF WINE FOR SUCH USE CONTRARYTO STATE LAW."
We have been advised by authorities of your state that such production of wine is contrary to state law. Therefore, you are cautioned that although Federal law provides for production of wine free of Federal tax for family use under the conditions set out on Treasury Form 1541, such production apparently would place you in violation of the laws of your state.
If you desire further information relative to state requirements or restrictions, it is suggested that you communicate with the liquor licensing authority of your state.
Very truly yours,
