GROWERS LICENSE FOR TESTING NEW GRAPEVINE VARIETIES Produced and Selected at the University of California, Davis, California, dated 19th of May, 1972 and signed 16 June, 1972Context
THIS AGREEMENT MADE AT Davis, California, this 19th day of May 1972 by and between the Regents of the University of California, hereinafter called "Licensor", of the first part, and Wilbur P. McDonald of St. Joseph, Missouri, hereinafter called the "Licensee", of the second part;
WITNESSETH AS FOLLOWS:
Licensor is the owner of or agent for the new grape varieties named below, and Licensee desires and agrees to grow the said plants for testing purposes for the benefit of the Licensor and Licensee, NOW THEREFORE, Licensor hereby grants Licensee in consideration of the sum of One Dollar paid by Licensee to Licensor a non-exclusive limited license to grow for the purpose of test purposes only and only subject to the following stipulations, the grapevines listed on the Schedule below in the quantities and of the descriptions thereon stated. Licensee covenants and agrees to operate under this license and to comply with the following conditions:
1. That all buds, scions, plants or other stocks received by it shall remain the absolute property of Licensor
2. That without specific license to do so it will not reproduce said plant or plants nor propagate . . . .
3. That any sport or sports discovered on such varieties while growing in the greenhouse or on the . . . .
4. That it will not ship, transport, transfer, or assign any of these plants to any other person or . . . .
5. That the Licensor has the right to terminate this license at any time, on which notice the . . . .
6. That it will comply with all instructions of Licensor relative to disposition of said plants, and . . . .
7. That it shall be liable in damages for any breach of this agreement with respect to plants not . . . .
