On the 31 May I discharge
Asa Jones. You wrote me that you would be
here and I waited for you to come. As you intimated
that Jones must again be imprisoned. You probably
would not have entertained such an opinion if you
had reflected. You know I presume that a person once
imprisoned & discharged (no matter how) it is a
final satisfaction of the debt and the body never
afterward, can be imprisoned. I therefore waited for
you to come home longer than I otherwise should
have done. One other reason Jonas said he was
intending to apply to the court to have his
allowance increased. His attorney was in full
belief the court would do it. I was in hopes
that the court would unthinkingly make the
order. I should have refused compliance. Jones
would have left the limits & we should then have
recovered the amount on the bond for the limits.
But the court were not fools enough to grant the
request. Before I let Jones go I prevailed on
him to give a writing stating that the judgment
should remain in full force and that execution
to pay the debt. I could get no better terms
I have not settled with the _______ for the fees due.
There will be something more to pay
I sent by Genl. Perkins an order on the Collect
for 621134 drawn by Huron County treasurer the
order was rather informal & I requested it to be left with
Saml. Quimby or W. Fitch in order that the
money might be retained when the treasurer
called for the amt. due that County. Please
ask M. Fitch if he has the amount of
the order in a situation that he can lend it
to be. And if so I wish him to lend it
by first opportunity.
