CHARLES BARRETT AGREEMENT REGARDING HIS UNSOLD LANDS IN HOPE, MAINE15 JUNE 1805 WITH ANNOTATIONS 5 JUNE 1806 AND 21 SEPTEMBER 1806 Transcription of the original document that was given to Walsh History Center of Camden Public Library by William B. Merrill, August 2018. Know all men by these presents that I Charles Barrett of New Ipswich, in the County of Hilsborough and State of New Hampshire Esq. Am Bound and Obliged unto Amos Barrett of Union. Gent. Ephraim Barrett of Camden Yeoman and Fergus McLain Yeoman and Archibald McLain both of Hope and all of the County of Lincoln and State of Massachusetts In the Sum of Six Thousand Dollars to be paid to the sd Amos, Ephraim Fergus and Archibald their Executors Administrators and assigns which sum well and truly to be paid to the sd Amos, Ephraim Fergus & Archibald I bind myself my Heirs Executors and Administrators firmly by these presents Sealed with my Seal dated this fifteenth day of June Annodomini Eighteen Hundred and Five The Conditions of the above obligation is such that whereas I the said Charles Barrett did undertake to perform certain duties and procure settlers on a tract of land for the Associates of the Lincolnshire Company (now the Town of Hope) for which Duties I was to and have Received a deed of two thirds of the lands in sd town and as I took the above sd Amos Barrett as a partner to perform one third part of sd duties and to receive one third part of the reward now in order to put sd Amos Barrett in possession of one third part of sd lands agreeably to my contract with him and to sell and convey half my two thirds to Ephraim Barrett and the other half to Fergus McLain and Archibald McLain it is agreed as follows Viz. that the sd lands which have not heretofore been sold shall be surveyed the present year and sd Amos Barrett to be at one third part of sd expense, and Ephraim Barrett at one third part except paying the Surveyor and Fergus McLain & Archibald McLain at one third part except paying the Surveyor which I agree to pay and it is further agreed that John Harkness shall be the Surveyor and so as soon as the survey shall be completed and the Surveyor shall make a certificate of the number of Acres of sd land I hereby agree to make and execute a good and sufficient deed to Amos Barrett of one third part of sd lands, free of expense to him and a deed of one third part of sd lands to sd Ephraim Barrett and the other third part to Fergus and Archibald McLain on their giving me their joint security for sd lands at two Dollars and fifty cents pr acre to be paid in ten years with interest to be paid annually from the date of this instrument now if the sd Charles Barrett shall well and truly perform the conditions of the above Obligation this instrument shall be void otherwise shall remain in full force and virtue Signd Sealed in presence of Charles Barrett and a Seal Benjn Meservey Nathan Blake Copy [End of page 1] June 5th 1806 Then received of Ephraim Barrett Fergus and Archibald McLain in full for one half of my two thirds of the within mentioned land and one year interest C B It is further agreed that sd land be estimated at eighteen hundred Acres twelve hundred of which Charles Barrett is to receive pay for the other Six hundred is to be deeded to Capt Amos Barrett of Union County of Lincoln by Ephraim Barrett of Camden & County aforesaid Charles Barrett Ephraim Barrett Copy Hope Sept 21st 1806 This is to certify that we do agree for Mr Ephraim Barrett to take a Deed of the within mentioned lands.
