Scope and Content

LAST WILL AND TESTAMENT I, HARRY BULL, of the Town of Hamptonburgh, Orange County, New York, being of sound and disposing mind and memory, do hereby make this my LAST WILL AND TESTAMENT in manner and form following: FIRST:— I direct my Executor and Executrix, hereinafter named, to pay as soon as they can do so conveniently all of my just debts, funeral and testamentary expenses. SECOND:— If, at the time of my death, I own my farm known as "Oakside Farm", located along the Sarah Wells Trail, in the Town of Hamptonburgh, Orange County, New York, consisting of approximately 271.86 acres of land with the buildings and improvements thereon (excepting thereout a small parcel conveyed to the Lehigh & Hudson River Railroad Co.), I give and I offer my son, HARRY CULVER BULL, Campbell Hall, New York, the option and right to purchase the same at any time within one year of my death for the sum of FORTY FIVE THOUSAND DOLLARS ($45,000.00) in cash, plus the amount due for principal and interest on any outstanding mortgage or mortgages which may be a lien or liens on said farm at the time of my death, which mortgage or mortgages and the interest due thereon, my said son shall assume and agree to pay according to the terms thereof; and I give, devise and bequeath from the cash payment of Forty Five Thousand Dollars ($45,000.00) received from said sale, the sum of Fifteen Thousand Dollars ($15,000.00) to my wife, HARRIET E. BULL; the sum of Fifteen Thousand Dollars ($15,000.00) to my son, HENRY F. Bull, 46 Prospect Avenue, Middletown, New York; and the sum of Fifteen Thousand Dollars ($15,000.00) to my daughter, MARGERY B. JACKSON, 20 Prospect Avenue, Middletown, New York; to be theirs absolutely. Should my said son, HARRY CULVER BULL elect to purchase said farm as aforesaid, he shall receive credit for any rent received by my Executors for the use of said farm from the time of my death until he obtains a deed therefor, which rental shall be applied on account of the purchase price, but my son, HARRY CULVER BULL, shall reimburse my estate for any State, Town, County and School taxes, insurance premiums, and mortgage installments of interest and principal, paid from the date of my death to the time of delivery of the deed. Should my son, HARRY CULVER BULL, fail to exercise said option to purchase my said farm, then the same shall become part of my residuary estate to be disposed of as therein provided. THIRD:- I give and bequeath to my daughter, MARGERY B. JACKSON, all my household furniture and furnishings now being in my residence upon the farm hereinbefore mentioned in the Town of Hamptonburgh, Orange County, N. Y. It is my wish, however, but in no sense mandatory, that my said daughter permit my said son, HENRY P. BULL, to take some of the articles of household furniture at any time that he may express a desire for the same. FOURTH:- All the rest, residue and remainder of my property, real, personal and mixed, of whatever name and nature, and wheresoever situated, I give, devise and bequeath to my wife, HARRIET E. BULL, and to my son, HENRY P. BULL, and to my daughter, MARGERY B. JACKSON, equally, share and share alike therein. If my wife, HARRIET E. BULL, predeceases me, then and in that event I give the share or part of my estate which I have given to her, to my son, HENRY P. BULL, and to my daughter, MARGERY B. JACKSON, equally. If my son, HENRY P. BULL, predeceases me, then and in that event I give the share or part of my estate which I have given to him, to his child or children surviving me. If my daughter, MARGERY B. JACKSON, predeceases me, then and in that event I give the share or part of my estate which I have given to her; to my son, HENRY P. BULL, or to his child or children then living, if he be then deceased. If my said son, HENRY P. BULL, predeceases me and leaves no child or children living at the time of my decease, and my said daughter, MARGERY B. JACKSON, is also deceased, then I give said share or part of my estate which I have given to them, to my wife, HARRIET E. BULL, and to my son, HARRY CULVER BULL, said equally, or to the survivor of them. FIFTH:- I hereby nominate, constitute and appoint my said son, HENRY P. BULL, to be the Executor, and my said daughter, MARGERY B. JACKSON, to be the Executrix, of this my Last Will and Testament, to serve without bond or security; and I give to the person who may qualify as the representative of my estate, full power and authority to sell and convey, mortgage or lease, any real or personal property which I may own. SIXTH:- Any and all Federal, State, foreign or other inheritance, estate, transfer, succession, death, or similar duties or taxes, whether levied, based or imposed upon, or measured by property that passes by my Will, or levied, based or imposed upon, or measured by any other property passing or vesting on or because of my death, shall be paid from and out of my residuary estate as an administration expense and shall not be equitably prorated. SEVENTH:- To the end that my said Executor and Executrix shall be able to open the safe which I own, and which is now in my residence, I will give the combination on a separate piece of paper to be folded in with my Will, but to form no part of same. LASTLY:- I do hereby revoke all former or other Wills or Codicils by me at any time made. IN WITNESS WHEREOF, I have hereunto set my hand and seal
