October 25, 1907. Joseph Merritt, Esq., Goshe n , N.Y. My dear Joe:-- I send you herewith a letter which I have received from James C. Beecher relating to the Greene Dower suit. I have made a calculation based upon the value of the property appraised for the transfer tax as follows: Appraised value of property $119,393.00 Less mortgages 8,640.00 ---------- 3)110,753.00 ---------- $36,917.66 .05 ----------- $ 1,845.8830 Age 41 years 13.244 ----------- Gross value of dower $24,446.87 In this calculation I have taken Mrs. Greene's age at forty-one years at the time of the death of her husband. I don't know whether, in view of the fact that she has received a part of the income from the lands since her husband's death, I have taken the proper age. Beecher's idea is to have Mrs. Greene, the widow, take the Orange County property at the appraised valuation, which will be $3010 over the mortgage of $1990. I have made an estimate to show what property would have to be set off to the widow in case of an actual partition, and I find that she would in some way have to participate in the property on Main, North Division and Washington Streets in this City, for the reason that the income from that property is greater than the combined income from all the other real estate. I have had a great deal of trouble in getting Beecher to do anything, and I think the proposition which he makes shows that he is somewhat fearful of the result of an actual partition. Will you please take the matter up with Mrs. Greene and let me know the result at which you arrive? Yours truly, ENC. W. H. Cuddeback
