"Points and Authorities of Freeman & Spence," A. M. W. de Temple vs. D. W. Alexander, Sheriff, Case 5773, Supreme Court of the State of California, ca. 1877. The printed item provides the points offered by Brunson & Eastman, attorneys for Temple and Workman assignees Daniel Freeman and E. F. Spence, in the suit filed by A. M. W. de Temple, which she won at the Los Angeles Superior Court. The matter refers to a judgement obtained by Arcadia Bandini Stearns Baker for cattle in compensation for moneys owed to her in the failure of the bank of Temple and Workman. As Sheriff, Alexander, a long-time friend of the Temples, seized the animals and was then sued by Mrs. Temple, who claimed most were owned by her minor children, John and Lucinda. Her attorney son, William, was also guardian for the minors and attorney for his mother. Because Freeman and Spence were assignees to the Temple and Workman bank at the time, they wre involved in the litigation. Five points of law in support of the argument are offered with citations of authorities in law. Aside from some browning and liquid stains on the bottom of pages, the condition is good.
